Transport and logistics compliance

Fleet compliance is where transport businesses get caught.

Starting a transport or trucking company, or growing a fleet? Driver contracts, NBCRFLI wage rates, driver hours, vehicle records and dangerous goods rules are where inspectors and clients look first.

Our Transport & Logistics Industry Pack is the deepest pack we build, because a fleet generates more compliance obligations than any other sector we serve.

The requirements

Six areas an inspector, a client or a tender committee checks. Here is what each one needs, and where our pack covers it.

Wages and the bargaining council

An NBCRFLI bargaining council compliance guide, so your wage rates and conditions match the road freight agreement. From Standard.

Operator and AARTO

Operator compliance, AARTO and dangerous goods guidance. Our AARTO guide states the position at its date of issue and what to re-check. From Standard.

Fleet and driver registers

The full set of fleet and driver registers, driver hours records, OHS and a hazard identification and risk assessment. From Standard.

POPIA for your staff

An employee privacy notice in every tier, with the complete POPIA set from Standard.

Company profile, tender templates and pricing

Transport services and owner-driver agreements, a company profile, tender response template, payroll register and a costing tool. In Premium.

Road freight wages

Which wage rules apply to you

Road freight and logistics wages are set by the sector bargaining council, not only by the national minimum wage.

Bargaining council configured. The National Bargaining Council for the Road Freight and Logistics Industry (NBCRFLI) sets wages and conditions for road freight and logistics employers. Our Standard and Premium tiers include an NBCRFLI compliance guide. AARTO is still moving, so our guide tells you what to re-check with the RTIA before relying on it.

Before you ask

Transport & Logistics questions

What documents do I need to start a transport company in South Africa?

You need written employment contracts for your drivers and staff, a disciplinary code, a leave policy, UIF and COIDA registration and a POPIA privacy notice. Fleet operators also need vehicle and driver records, driver hours records and, where relevant, dangerous goods documentation. Clients usually ask for a company profile, a B-BBEE affidavit and a transport services agreement.

Is there a bargaining council for road freight?

Yes. The National Bargaining Council for the Road Freight and Logistics Industry (NBCRFLI) sets wages and conditions for the sector. Our Standard and Premium tiers include an NBCRFLI compliance guide.

Is the AARTO information current?

Our AARTO and demerit system guide states the position as at its date of issue and tells you what to re-check with the RTIA before relying on it. We do not publish a date as settled when it is not.

Do you have an owner-driver agreement?

Yes. The Premium tier includes an owner-driver agreement and a transport services agreement.

Can I edit the templates?

Yes. Every document is supplied in Microsoft Word or Excel, completed with your company details. You can edit and reissue them for as long as you trade.

Do you register my company or handle my tax?

We handle CIPC filings through our CIPC & Statutory Filings service. We do not do SARS registrations or tax work. That is your accountant's work, and we will say so rather than guess.

Is this legal advice?

No. ComplianceIQ SA provides business compliance advisory services. Our guidance does not constitute legal advice. For matters requiring formal legal representation, we recommend consulting a qualified attorney or registered practitioner.
